Landscaping Policy & Guidelines

The Townhomes on Capitol Hill (the “Townhomes”) current policy allows flowers in window boxes and planters on porches or just outside a Member’s unit provided they are displayed in a reasonable and pleasant manner as determined by the Townhomes Landscaping Committee. It is the Member’s responsibility to keep plantings well maintained and up to community standards. Every Member has the opportunity to do additional plantings to enhance “their front yard common area” providing it is within the community standards to enhance our surroundings and is well maintained. Backyards remain the sole responsibility of the member residing in those units.

A Member’s plan for new plantings and modifications to the front yard must be presented to the Landscaping Committee for approval prior to any plantings or modifications. Individuals wishing to submit a planting proposal must have written approval of immediate neighbors, above and/or below, in order to proceed. We encourage collaborations between neighbors for the benefit of our community beautification process. Submissions should have as much detail as possible and should include both a narrative describing the plantings as well as a visual display, picture or drawing of the intended plants and landscaping. Proposals and plans for plantings shall be submitted to the Townhomes Landscaping Committee via Corcoran Jennison, the Townhomes property manager, or by completing the online submission form on the Townhomes website. 

Members are financially responsible for the installation of the proposed modifications to the front yards, and shall plant at their own risk. Members are responsible for the general maintenance and watering of the front yards once plants, shrubs and flowers are planted and any other approved modifications are installed. Townhomes on Capitol Hill (THCH) is not responsible for any damage to the plantings unless the damage is caused by one of its agents (i.e. employee, independent contractors, etc.).

The landscaper contracted by the Townhomes through the Landscaping Committee shall not remove any plantings without prior approval of the Landscaping Committee. This does not prohibit the landscaper from general maintenance of the hedges and trees in the front yards and other common areas of the community.

Members are not permitted to remove any existing plantings on the property or add any plantings unless prior approval is granted by the Townhomes Landscaping Committee. This includes plantings in front yards, parking lots, tree boxes and areas surrounding the Community Center. Such actions will result in fees assessed to the Member for the replacement value of the plantings, labor costs, and any additional expenses incurred to bring the yard back to the community standards prior to removal. In addition to these fees, Members who do not adhere to the aforementioned rules and regulations will incur the following fines and penalties:

  • Following the first incident, Member will receive a written Notice of Violation and a $25 fine.
  • Following the second incident, Member will receive a written Notice of Violation and a $50 fine. 
  • Following the third incident, Member will receive a written Notice of Violation and a $100 fine. At this time, Member will be in default of the Proprietary Lease and termination proceedings will commence. In addition, Member will be deemed out of good standing and ineligible to receive tenure credits for that year.
  • During this time, Member is still responsible for the carrying charge. Failure to pay the carrying charge will result in it and any other outstanding debts being withheld from Member’s share price distribution at move-out.
  • Any fines incurred for violation of the policy must be paid by Member on or before the 5th day of the following month, i.e. a violation received on April 15th must be paid in full on or before May 5th.

The Townhomesand its manager, Corcoran Jennison (“Management”), will exercise due diligence and good faith when assessing a violation. A Member has the right to dispute a Notice of Violation. Disputes must be made in writingto the Townhomes Board of Directors via Management within 30 days of receipt of a Notice of Violation and Member must appear at the next Townhomes Board Meeting to present their dispute.

Members may report violations of the Landscaping Policy to the Townhomes Landscaping Committee via Corcoran Jennison, the Townhomes property manager, or by completing the online submission form on the Townhomes website. 

As of the date of this Landscaping Policy, the Townhomes will be responsible for the regular watering of all front yards and community spaces. This watering shall occur 1-2 times per week as agreed upon by the Landscaper and the Landscape Committee. Members are required to supplement watering as needed based on the planting modifications to their front yard. 

Existing front yards and those granted approval by the Landscape Committee as of May 1, 2017 are grandfathered into the landscape plan. Once approved, Members must re-submit plans for seasonal changes to the front yard if those changes are substantially different from the original plan.
